Property scams

Identity fraud and scams are increasingly prevalent throughout the community, and the property industry is not immune to falling victim to such events.

Bogus sellers

Two highly publicised incidents in September 2010 and March/April 2011 resulted in properties being sold in Western Australia without the knowledge and consent of the lawful property owners.

These sales were undertaken by real estate agents who were contacted by criminals masquerading as the true owners.

Claiming compensation

A consumer may be able to claim for compensation from the business if a problem with a product or service causes:

  • the consumer to pay more money because it didn’t meet the consumer guarantees
  • injury to themselves or others
  • damage to their property or belongings.

This is particularly the case where the business failed to meet a consumer guarantee.

A business does not have to pay if the damage or loss:

Pool Safety

Portable pools can pose a safety risk, especially for children under the age of five, because they are:

  • not usually fenced and
  • not completely emptied after use.

Pool fencing laws apply to pools, including portable pools 300mm (30cam) deep or more.

Adults should always actively supervise children from within arm's reach when they are in and around the water.
