Charity licensing conditions

Standard conditions apply to all licences issued under the Charitable Collections Act 1946 (the Act), including licences deemed for Australian Charities and Not-for-profits Commission registered entities. Additional licence conditions may be imposed, varied or revoked by the Commissioner at any time. 

Consumer Protection may cancel your organisation’s licence if you do not follow these conditions.

Disqualified persons

Some people are legally not allowed to manage a corporation, incorporated association or registered charity.  They are known as a disqualified person.

You must not appoint or keep a disqualified person on your governing body, unless you have written consent of the Commissioner. 

A governing body includes a committee, board of management or trustees.

Reporting

Australian Charities and Not-for-profit Commission (ACNC) registered organisations

You do not have to give collection records to Consumer Protection unless the Commissioner ask you to.  

Organisations not registered with ACNC

You must send your collection records to Consumer Protection within six months after the end of each financial year. 

What you need to provide depends on how much you collected during the financial year.

When you stop collecting or are no longer registered

You must notify Consumer Protection immediately if you:

  • have not collected donations in WA for 12 months
  • are no longer registered with the ACNC. 

You must also include final financial records when ending a licence.
