Debt collectors

Debt collectors must be licensed in Western Australia under the Debt Collectors Licensing Act 1964 .

Who needs a licence?

You need a debt collectors licence if you:

  • work as or say you are a debt collector
  • do any debt collecting tasks
  • run a debt collector business.

Working as a debt collector without a licence is against the Act and may incur a fine of up to $50 000.

Bonds manual forms

Private landlords and landlord organisations can choose between using BondsOnline or manual forms. 

Real estate agents must use BondsOnline. We may accept a manual form in special cases. You must include a written explanation why BondsOnline can't be used.

There are two types of manual forms:

Infringements - settlement agents

The Settlement Agents Act 1981 (the Act) imposes serious obligations on the settlement industry and the way it operates.  Failing to meet those obligations can result in the Department issuing an infringement notice, prosecuting offending licence holders before a court or initiating disciplinary action in the State Administrative Tribunal (SAT).

How to incorporate an association

The major steps for applying for incorporation are:

  1. Choose a name.
  2. Adopt a set of rules which comply with the requirements of the Act. An association can choose to prepare its own rules or adopt the prescribed model rules; and
  3. Lodge an application for incorporation with the required accompanying documentation.
