Bonds Administration management of personal information policy

The Bond Administrator and authorised staff (we) must follow rules to keep your information safe and maintain your privacy. 

This policy explains how we collect, store, use and share your personal information. 

Privacy Collection Notice

The personal information you provide here will be used by the Department of Local Government, Industry Regulation and Safety (LGIRS) to:

  • assist the Bond Administrator (Bonds Administration) with lodging, making changes to, and releasing residential tenancy and residential park security bonds (and pet bonds, where applicable) in Western Australia; and
  • maintain bond records, confirm your identity to provide information to you about your bond, and meet relevant legislative, audit, reporting and compliance requirements.

We may provide this information to:

  • relevant entities as authorised or required by law, such as the Commissioner for Consumer Protection, the Magistrates Court, the State Administrative Tribunal, the Housing Authority, law enforcement agencies, and Australian Taxation Office;
  • internal staff who support service delivery and related functions including communications and education; and
  • other entities, in a way that does not identify you, such as statistical reporting on the number of bonds held with Bonds Administration.

Providing us with the requested information is required to enable Bonds Administration to administer security bonds in accordance with the Residential Tenancies Act 1987, Residential Parks (Long-stay Tenants) Act 2006, and related legislation. If you chose not to provide it, we may be unable to process your application to lodge, make changes to, or release your bond, or provide any other services we provide in BondsOnline.

Information we collect

We (the Bond Administrator and authorised staff) may collect personal information in connection with the relevant legislation, including your:

  • name and address
  • contact details
  • bank account details.

Why we need your information

We collect and use your information to:

  • confirm your identity
  • action bond lodgement transfers and repayments
  • comply with the requirements of relevant legislation
  • assist the Magistrates Court within the context of security bond disputes
  • contact you about your application or a rental bond issue
  • any other ways required by law.

Sharing your information

We may use and share your information in the following scenarios: 

  • if the law allows or requires it, e.g. by court order for the WA Police or the Australian Tax Office
  • in a way that does not identify you, e.g. sharing the number of bonds held with the Bond Administrator
  • to refer to a Security Bond Release Application to the Commissioner for Consumer Protection for a decision under section 81I of the Residential Tenancies Act 1987.

Storage and security of your information

We will use reasonable measures to ensure your information is kept safe and secure. 

Bonds Administration staff are trained in using secure systems to protect your information. Only staff can access your information via: 

  • secure buildings with smartcard access
  • secure systems with limited authorised access
  • strong personalised passwords
  • other departmental security policies which staff must follow.

The Bond Administrator aims to keep personal information only for as long as required by law, such as the State Records Act 2000. When we no longer need it, we take reasonable steps to destroy or de-identify it.

Access and updating your information

You can contact us to ask to see your information. If your information is wrong or needs updating, we may be able to update it. In some cases, we may ask you to update it through your property manager.
