Each licence holder has a governing body responsible for the management of the organisation and its operations. The name of the governing body can vary depending on the organisation’s structure and may be known as the management committee, board of directors or trustees.
When applying for a licence, it is a requirement to provide Consumer Protection with the details of Executive Officers (EOs) who have the power to make decisions about the management of the organisation. Examples of EOs include:
- Chairperson or President
- Trustee
- Committee member
- Secretary
- Treasurer
- Director
- CEO
Change of executive officers
Details of any changes to the licence holder’s EOs must be lodged with Consumer Protection within one (1) month of the change occurring.

Disqualified persons
Under the standard licence conditions, certain persons are disqualified from holding positions on the organisation’s governing body unless written consent is given by the Commissioner for Consumer Protection.
A disqualified person is anyone who:
- is disqualified from managing corporations under the Corporations Act 2001 (Cth) Part 2D.6 (more information available from the Australian Securities & Investments Commission (ASIC) website); or
- must not accept appointment or act as a member of a management committee of an incorporated association under the Associations Incorporation Act 2015 (WA) Division 1 (refer to our factsheet Eligibility requirements for committee members); or
- has been disqualified from acting as a responsible person for a charity by the Commissioner of the ACNC under the Australian Charities and Not-for-profits Commission Regulations 2013 (Cth) Subdivision 45-B Governance Standards (more information available from the Australian Charities and Not-for-profits Commission (ACNC) website).
