The Department of Commerce wishes to notify agents and property managers of some recent changes by the Magistrates Court and Australia Post in relation to their services.
Increase in application filing fee with Magistrates Court
As from 1 January 2016, the application filing fee increased from $26.70 to $53.20 in relation to residential tenancies. This fee applies to both the Application for disposal of bond money (Form 6) and the Application for court order (Form 12).
The Co-operatives Amendment Act 2016 (the Act), was reformed in 2017. The changes aligned co-operatives law in Western Australia with co-operatives legislation in other states and territories and allow Western Australia to participate in the Co-operatives National Law (CNL).

As outlined in e-bulletin issue 53, the regulation of fees will cease as of 3 February 2016. Settlement agents are able to determine the fee structure to charge their client for services in executing settlement transactions. A new fee disclosure rule will also be included in the Settlement Agents’ Code of Conduct 1982.
As of 3 February 2016, regulation of fees has ceased. Settlement agents are now able to determine what fee to charge their client for their services in executing the transaction.

Following consultation with industry in 2014, the Minister for Commerce has announced the scale of maximum fees for settlement agents will be removed.

Following consultation with industry in 2014, the Minister for Commerce has announced the scale of maximum fees fixed for land valuers will be removed.
The model rules are a standard set of rules that have been developed for use by associations who do not wish to develop their own rules. These rules meet all the requirements of the Act and provide a suitable governance framework for an incorporated association.
