These guidelines explain the new provisions of the Retirement Villages Act 1992 (the Act) that prohibit certain persons from being the administering body or being concerned, directly or indirectly, in the administration of a retirement village unless the person holds an exemption certificate granted by the Commissioner.

All agents who hold a current triennial certificate and have held or received monies in trust during the 2017 calendar year, or part thereof, are required to have their trust accounts audited for the period by an auditor approved by the Commissioner for Consumer Protection (the Commissioner).

A property manager has been reprimanded and fined $2,500 by the State Administrative Tribunal after falling victim to a holiday accommodation booking scam which resulted in a $45,000 loss for her employer, a Scarborough real estate agency.

An Ellenbrook settlement agent has been fined $14,000 by the State Administrative Tribunal (SAT) for their role in relation to two failed Pilbara strata property deals involving what is termed ‘mezzanine financing’.
A Joondalup real estate agency and a sales representative will have to pay a total of $21,200 in penalties and costs ordered by the State Administrative Tribunal after a Balga house was sold without the consent of one of the owners.
The owners were a couple who had moved overseas and the agency was duped by the husband into believing that his wife and children were killed by the Taliban in Afghanistan.

A Wandi property manager has been fined $5,000 by the Perth Magistrates Court for operating without a licence and a current triennial certificate.
Josephine Wei-Wei Liau was also ordered to pay costs of $1,784 after being convicted on 20 November 2017 for holding herself out as a real estate agent and demanding and receiving monies in respect of services as an agent while unlicensed. Ms Liau was managing a property in Willetton through her unregistered business Emerald Property Management after her registration expired in March 2013.
