Use this template to draft a disclosure statement of a proposed distributing co-operative. It must be submitted to the Registrar at least 35 days before the formation meeting is due to be held. The disclosure statement must contain the information necessary to ensure that eligible members are adequately informed of the nature and extent of a person’s financial involvement or liability as a member of the co-operative under the Act (section 16(3)(a)-(g)). A shorter period than 35 days may be allowed by the Registrar in exceptional circumstances.
The Department of Energy, Mines, Industry Regulation and Safety – Consumer Protection Division (Consumer Protection) has undertaken a review of the Petroleum Retailers Rights and Liabilities Act 1982 (WA) (the PRRL Act ). This review indicates that industry usage of the PRRL Act since its introduction has been minimal and changes in the regulatory environment have meant that the objectives of the legislation are now being met by other means. Practical difficulties associated with the use of the PRRL Act also mean that use by retailers is considered unlikely.
The Petroleum Retailers Rights and Liabilities Act 1982 (WA) (PRRLA) was introduced in 1982 to increase the bargaining power of fuel retailer to better negotiate competitive prices for fuel supplies by giving retailers the rights to purchase up to 50 percent of their fuel supplies from suppliers other than their primary supplier and to use a franchisor’s storage and dispensing equipment for fuel purchased from other suppliers.
In 2001, amendments were made to the PRRLA to address issues identified with the Act and ensure that the rights in the PRRLA could be exercised.
When buying a recreational vehicle (RV) such as a caravan, camper trailer or camper van, you have different consumer rights depending on whether you bought it from a private seller or a dealer.
Either way, it’s important to understand there is no ‘cooling-off’ period in WA for RV purchases. This means once you’ve signed a contract at a dealership or paid a private seller, you are committed to the sale.
